Robbinsville Juvenile Distribution Charges Dismissed

The head of our criminal defense team, Jonathan F. Marshall, was retained to defend a Robbinsville juvenile who was charged with an assortment of drug offenses. This seventeen (17) year old was facing a charge for second degree distribution of a controlled dangerous substance (“CDS”) and distribution in a public park zone stemming from sales of Xanax, cocaine and marijuana. The Robbinsville Police Department made the arrest following cooperation by a confidential informant who had purchased cds/drugs from the juvenile.

In accordance with N.J.S.A. 2C:35-10.5, it is a second degree crime to distribute or sell 100 or more dosage units of a prescription legend drug. An entire separate and additional offense for distribution of CDS in a public park arises when the conduct occurs within 500 feet of a public park or housing project. The juvenile penalties for second degree distribution of CDS include up to 3 years in juvenile detention. A public park offense is also a second degree with punishment that includes an additional 3 years of possible incarceration.

Mr. Marshall fought the charges over a period of several months. The eventually outcome included a dismissal of all distribution charges despite seizure of over 300 dosage units, cocaine, marijuana and cash. This was an extremely favorable result from both the perspective of our Mercer County Juvenile Lawyers and our clients.
