Being under the influence is defined in New Jersey as “a substantial deterioration or diminution of the mental faculties or physical capabilities of a person whether it be due to intoxicating liquor, narcotic, hallucinogenic or habit producing drugs.” When the substance purportedly causing the N.J.S.A. 39:4-50 violation is marijuana, the state must show that the affect of the drug on the physical coordination and mental faculties rendered the accused a danger to himself and other drivers.
