  • Possession of 50 Grams or Less of Marijuana. It is a disorderly persons offense under N.J.S.A. 2C:35-10 to possess 50 grams or less of marijuana. This type of charge is essentially a misdemeanor but carries up to 6 months in the county jail and a fine of up to $1,000. An individual convicted of possession of marijuana is also subject to a mandatory driver’s license suspension of 6-24 months.
  • Possession of Over 50 Grams of Marijuana. It is a fourth degree crime to possess more than 50 grams of marijuana. The penalties for this offense include up to eighteen months of incarceration and a fine of up to $25,000. The same 6-24 month license revocation applies at the time of sentencing for fourth degree possession of marijuana.

The court has limited jurisdiction to decide disorderly persons offenses like a charge under 2C:35-10(a)(4). A Fourth degree crime for possession of over 50 grams of marijuana is an indictable offense that falls outside the authority of the municipal court in East Windsor. Fourth degree cases falling under 2C:35-10(a)(3) can only be handled by the Mercer County Superior Court, which is located at 175 S Broad St, Trenton, NJ 08608.
