Drug Paraphernalia Offense in Ewing New Jersey

Drug paraphernalia refers to any item used in the process of cultivating, manufacturing, transporting, or consuming illegal drugs. Many of these items have legal uses as well and because of this, the court must prove that a piece of alleged paraphernalia was using in conjunction with an illegal drug in order to find a defendant guilty. Possession of drug paraphernalia is a disorderly persons offense, the penalties for which are a jail term of up to six months and a fine of up to $1,000.   • Grinders. Herb grinders are metal devices used to grind tobacco, marijuana, cocaine and substances so that they are finer in composition. It is illegal to possess a grinder when its use is to prepare or ingest drugs/cds illegally.
  • Scales. Small countertop scales are used to weigh out portions of drugs for buyers. They are also used to weigh out portions of food.
  • Syringes and Needles. Syringes and needles are most often assumed to be associated with heroin use. But they have many other uses, such as injecting prescription medication.
  • Empty Bags and Other Containers. An empty plastic baggie can be assumed to have carried an illegal substance, potentially saddling an individual with a drug paraphernalia charge. Other containers, such as plastic food containers or glass jars, can also be assumed to have been used to store or transport an illegal drug.
