A Highstown traffic ticket for possession of CDS in a motor vehicle arises out of N.J.S.A. 39:4-49.1. This law is triggered if you “operate a motor vehicle on any highway while knowingly having in his possession or in the motor vehicle any controlled dangerous substance as classified in Schedules I, II, III, IV and V”.  A fundamental element of this charge is the presence of “CDS”, also referred to as a drug. The term includes any form of CDS that is possessed illegally. Schedule I drugs that are illegal to possess in any quantity like cocaine, heroin, MDMA and even marijuana, obviously fall under 39:4-49.1.
