Mercer County Offense For Operating a Drug Production Facility

A drug distribution offense can be significantly more complicated when it involves operating a drug production facility in violation of N.J.S.A. 2C:35-4. This law applies to facilities used to produce any Schedule I or II CDS and also the following drugs specifically:

methamphetamine, lysergic acid diethylamide, phencyclidine, gamma hydroxybutyrate, flunitrazepam, methamphetamine, lysergic acid diethylamide, phencyclidine, gamma hydroxybutyrate, flunitrazepam, marijuana in an amount greater than five pounds or ten plants.

In terms of what constitutes “operating”, the law extends to anyone who maintains, operates, aids or promotes a CDS production facility. Someone maintains a premises when there is continuity in use of a place on more than one occasion to manufacture drugs (e.g. owner of property, tenant, etc.). The charge also applies to those who knowingly aid, promote or finances an operation.

Enhanced Fine. The normal fine for a first degree drug distribution offense is enhanced to a maximum of $750,000 or five times the street value of the CDS.

Prison Term & Period of Parole Ineligibility. Although the prison term for this charge remains at 10-20 years, 2C:35-4 triggers a period of parole ineligibility that must be set at between one-third and one-half of the sentence imposed. A defendant must serve this minimum term before they may be considered for parole.

Impact of Prior Record & Distribution Charges. It is important to keep in mind that this offense applies in addition to whatever distribution violation is also filed. You are also subject to sentencing in accordance with the Brimage Guidelines if this would constitute your second or subsequent conviction for distributing CDS.
