Marijuana Possession Charge in Princeton New Jersey

Although it might seem illogical, marijuana is included on Schedule I of the CDS schedules. Drugs classified on Schedule I are considered the most addictive, widely abused, and lack any accepted medical use. N.J.S.A. 2C:35-10 makes it a crime to knowingly possess CDS with a valid prescription. It also makes it illegal to use or be under the influence of marijuana and other illegal drugs. Possessing in excess of 50 grams of marijuana results in a violation of 2C:35-10a(3), a fourth degree crime. This variety of marijuana possession is a felony that can only be dealt with at the county courthouse in Trenton. It is a disorderly persons offense to possess 50 grams or less of marijuana. This grade of possession of marijuana is heard in Princeton Municipal Court.

Princeton Marijuana Possession Penalties

Possession of more than 50 grams of marijuana is an indictable crime of the fourth degree. Judges can sentence you to serve up to 18 months in prison, pay fines up to $25,000 and suspend your driver’s license for a minimum of six months to a maximum of 24 months.

The penalties for possession of 50 grams or less of marijuana are also extensive. A disorderly persons offense for possession of 50 grams or less of marijuana carries up to $1,000 in fines, a license suspension of 6-24 months and up to 6 months in the Mercer County Jail.
