Possession of MDMA, Ecstasy & Molly
N.J.S.A. 2C:35-10 makes it a third degree crime to possess MDMA, known by the street names of Ecstasy and Molly. A conviction for possession of MDMA at the Trenton Courthouse results in a fine of up to $35,000 and the possibility of up to 5 years in prison. An individual is also subject to a suspension of his/her driver’s license for 6-24 at the time of sentencing.
Distribution and Possession With Intent to Distribute MDMA, Ecstasy & Molly
Distribution of MDMA in violation of N.J.S.A. 2C:35-5 is a third degree, second degree or first degree crime depending on the quantity being sold or possessed with the intention of selling. It is a third degree crime to distribute less than a half ounce of Ecstasy or Molly. Distribution of at least one half ounce but less than five ounces of MDMA/Ecstasy/Molly is a second degree crime. Possession with intent to distribute or selling five ounces or more of this cds is a first degree crime. The penalties for selling/distributing MDMA are set forth in the table below.
