Sexual Assault Charge at TCNJ Ewing New Jersey
The offense of sexual assault is set forth at N.J.S.A 2C:14-2c. An individual commits this charge if they commit an act of sexual penetration by physical force or coercion or with a victim that is at least 16 but less than 18 years old. Sexual assault is a second degree crime. A rape case is enhanced to aggravated sexual assault, a first degree crime, if the conduct occurs: (1) during the commission of a robbery, kidnapping, homicide, aggravated assault, burglary, arson or criminal escape; (2) while the actor is armed; (3) while the actor is aided by another and force is used; (4) involves physical force and severe personal injury is sustained to the victim or (5) the victim is physically helpless or incapacitated so that they are incapable of providing consent.
The penalties for sexual assault include 5-10 years in prison and a fine of up to $150,000. Aggravated sexual assault results in a prison term of 10-20 years and a maximum fine of $200,000. An individual convicted of either offense is also subject to sex offender registration under Megan’s Law.
TCNJ Criminal Sexual Contact Charge
The charge of criminal sexual contact is triggered under N.J.S.A. 2C:14-3 if the actor has sexual contact with the victim under the circumstances required to commit a sexual assault. Criminal sexual contact is a fourth degree crime. Aggravated criminal sexual contact, a third degree crime, results when sexual contact occurs under the circumstances previously set forth for aggravated sexual assault.
Fourth degree criminal sexual contact, also referred to as fondly, triggers a fine of up to $10,000 and up to 18 months in prison. Third degree aggravated criminal sexual contact carries a fine that can reach $15,000 and up to 5 years in prison.
