Sexual Assault Charge at Princeton University
An individual is exposed to a Princeton University sexual assault charge under N.J.S.A. 2C:14-2, a second degree crime, if they engage in sexual penetration by physical force or coercion without severe personal injury to the victim. A rape offense is enhanced to aggravated sexual assault, a first degree crime, if: (1) the incident is committed during a robbery, kidnapping, homicide, aggravated assault on another, burglary, arson or criminal escape; (2) the actor is armed or appears to be armed; (3) the actor is aided or abetted by another person who uses force or coercion; (4) the actor uses physical force or coercion and severe personal injury is sustained by the victim; or (5) the victim was physically helpless or incapacitated so that they were incapable of providing consent. Second degree sexual assault results in a prison term of 5-10 years, a fine of up to $150,000 and mandatory registration as a sex offender under Megan’s Law. First degree aggravated sexual assault carries a period of incarceration of 10-20 years, potential fine of $200,000 and community supervision for life, as well as compliance with Megan’s Law.
Princeton University Criminal Sexual Contact Offense
Criminal sexual contact is referred to as fondling in the Princeton University Annual Safety Reports. As you can see from the table above, there were three arrests/offenses for this violation during 2015 at the school. Criminal sexual contact is committed contrary to N.J.S.A. 2C:14-3 if the actor commits an act of sexual contact by physical force or coercion. The charge escalates from a fourth degree crime to a third degree crime of aggravated criminal sexual contact if the incident occurs under the circumstances set forth in (1) through (5) above. Fourth degree criminal sexual contact results in up to 18 months in prison and a fine of up 18 months. A third degree crime for aggravated criminal sexual contact carries a fine of up to $15,000 and up to 5 years in prison.
