Simple Assault Offense in Ewing New Jersey

Simple assault is defined under N.J.S.A. 2C:12-1 as conduct that involves one of the following:

  • An individual knowingly, recklessly, or purposefully caused another party to suffer bodily harm or attempted to do so;
  • An individual negligently causes bodily injury to another party with a deadly weapon;  or   
  • An individual used physical menace in an attempt to cause another party to fear for his or her bodily safety.    

When an individual is convicted of a disorderly persons offense for simple assault in Ewing Municipal Court, they face the following penalties:

  • A fine of up to $1,000; and
  • Up to six months in jail.

There is an exception to this charge. When two or more parties engage in a consensual fight, they can each be charged with a petty disorderly persons offense. The penalty for this is a fine of up to $500 and up to 30 days in the Mercer County Jail.

Assault is the act of intentionally injuring another party without legal justification to do so. This includes attempts to intentionally injure another party. New Jersey law recognizes two types of assault: simple assault and aggravated assault. Aggravated assault is generally charged as a fourth degree crime in New Jersey, but it can be a third or second degree crime depending on the severity of the victim’s injury and the manner in which it is committed. It is differentiated from simple assault because it typically involves more severe injuries, but even simple assaults against individuals granted special protection by the law may be charged as aggravated assaults. These individuals include, but are not limited to, law enforcement officers, court justices, individuals employed by the Department of Corrections, and public school employees.
