The Leader of a Narcotics Trafficking Network law is set forth at N.J.S.A. 2C:35-3. The statute is directed at those who act as the leader of a narcotics trafficking network, which means a person that:
conspires with two or more other persons in a scheme or course of conduct to unlawfully manufacture, distribute, dispense, bring into or transport in this State methamphetamine, lysergic acid diethylamide, phencyclidine, gamma hydroxybutyrate, flunitrazepam or any controlled dangerous substance classified in Schedule I or II, or any controlled substance analog thereof as a financier, or as an organizer, supervisor or manager of at least one other person.
Elements of Offense. When you dissect this law, there are six elements of proof that must be established, beyond reasonable doubt, to convict someone under 2C:35-3. The prosecutor must establish that: (1) the drug involved is methamphetamine, lysergic acid diethylamide, phencyclidine gamma hydroxybutyrate, flunitrazepam, or another CDS contained on Schedule I or II; (2) there was a scheme or course of conduct to manufacture, distribute, dispense or transport the substance; (3) the conduct was undertaken for profit; (4) the accused purposely promoted or facilitated the scheme or course of conduct; (5) in accordance with an agreement with at least one other person to commit or aid in the planning of the offense; and (6) defendant was an organizer, supervisor, financier, or manager in the conspiracy.
Penalties. The penalties to be imposed for leading a narcotics trafficking network are extreme at the time of sentencing at the Mercer County Superior Court in Trenton. You must be sent to prison for life with a minimum term of 25 years that must be served before you can even be considered for parole. There is also a fine of up to $750,000 or five times the street value of the cds involved, whichever is greater, that may be imposed.
Merger of Charges. A conviction under 2C:35-3 does not merge with an offense for distribution of cocaine, heroin, MDMA, methamphetamine, marijuana or another drug.
