Mercer County Promoting Gambling Charge: What You Need To Know
There are two varieties of promoting gambling that can arise under N.J.S.A. 2C:37-2. The headings below outline each type of promoting gambling and the important aspects of the violation.
- Participation in the Proceeds of Gambling Activity. A person is guilty of promoting gambling if he knowingly accepts or receives money or other property pursuant to an agreement or understanding with any person whereby he participates or will participate in the proceeds of a gambling activity. For this form of promoting gambling to occur, the prosecutor must prove that defendant: (1) accepted or received money or other property; (2) the property or money was acquired or risked in a contest; (3) he or she received something out of the proceeds of the gambling activity other than personal winnings; and (4) he or she knew that the money was received for the purposes of gambling and that he was to be paid out of the gambling proceeds.
- Materially Aiding Gambling Activity. The second form of promoting gambling targets those who materially aid a gambling operation. N.J.S.A. 2C:37-2 sets forth activities that promote gambling in this manner including those who create or establish a game of chance, provide or maintain the premises for the enterprise, those who induce placing of bets, conduct the game or contest and those who provide the financial, recording or other phases of the operation
Penalties for Promoting Gambling
A promoting gambling charge can be filed as a third degree or fourth degree crime or as a disorderly persons offense. The headings below discuss how grading and penalties are determined in a promoting gambling case.
- The largest percentage of 2C:37-2 charges result in a third degree crime. This is the case where the accused: (1) engages in bookmaking and receives or accepts more than five bets totaling more than $1,000 in a single day; (2) is involved in a lottery operation and receives money or records from a person other than the player; or (3) is involved in a lottery operation and receives more than $100 in any one day. A third degree crime for promoting gambling results in a fine of up to $35,000 and 3-5 years in prison.
- It is a fourth degree crime for an individual to receive or accept three or more bets in any two week period. A fourth degree crime for promoting gambling carries a fine of up to $25,000 and up to 18 months in state prison.
- In all other situations, promoting gambling is a disorderly persons offense punishable by a fine of up to $10,000 and six months in the county jail.
