The largest block of cds charges issued at TCNJ involve personal possession under N.J.S.A. 2C:35-10. Possession can result in a disorderly persons offense, a misdemeanor, or an indictable crime of the fourth degree or third degree, depending on the type of drug involved. The grading of drug possession is as follows:

  • Disorderly Persons Offense. Possession of 50 grams or less of marijuana at TCNJ is a disorderly persons offense. Possession of four or fewer dosage units of a prescription legend drug such as Xanax, Adderall, Oxycodone or Hydrocodone.
  • Fourth Degree Crime. Possessing more than 50 grams of marijuana is a fourth degree crime. It is also a fourth degree crime to possess five or more dosage units of a prescription legend drug. Possessing a Schedule V drug likewise results in a fourth degree crime.
  • Third Degree Crime. Personal possession of cocaine, heroin, MDMA, methamphetamine and other Schedule I, II, III & IV CDS is a third degree crime.
Distribution of CDS

The grading of a TCNJ distribution offense is set forth in N.J.S.A. 2C:35-5. With the exception marijuana and hash, distributing or possession with intent to distribute CDS is a felony offense of the fourth degree, third degree, second degree or first degree. Distribution of less than a half once of heroin, cocaine or MDMA is a third degree crime. Distributing at least one-half ounce but less than five ounces of these drugs is a second degree crime. It is a first degree crime to distribute or be in possession of five ounces or more of cocaine, heroin or MDMA. Distribution of less than one ounce of marijuana at TCNJ is a fourth degree crime. Selling at least an ounce but less than five pounds is a third degree crime. It is a second degree crime to distribution or sell at least five pounds but less than twenty-five pounds of marijuana. Selling, distributing or possessing 25 or more pounds of marijuana is a first degree crime.

Disciplinary Proceedings for Violating the TCNJ Drug Policy. There is a strict drug policy at TCNJ for possession and distribution of drugs on campus. Violation of the code also results in disciplinary proceedings on top of criminal charges. It is not uncommon for a violation of the drug policy to result in sanctions to include suspension or even expulsion from the college.
